Summary:

Serves as chief legal adviser to MCCA; provides day-to-day legal, strategic and policy advice and service on a diverse range of Authority matters; counsels management with respect to legal ramifications of the Authority’s activities and undertakings, legal services as required in judicial, administrative and regulatory proceedings. Oversees compliance and regulatory matters; Utilizes outside counsel to complement available internal legal resources in performing the duties.

Some of the following will be undertaken under the direction of or in conjunction with the Assistant or Associate General Counsel

  • Prepares legal documents and contracts
  • Either personally or through theAssistant orAssociate General Counsel, supervises legal aspects of the Authority’s organizational and business transactions. Prepares reports and statements ofa legalnature.
  • Participates in senior management policy deliberations andidentifieslegal issues and related questions.
  • Assists in governmental relations and employee and labor relations as requested.
  • Participates in the union negotiations
  • Advises andassistsin insurance procedures and risk management
  • Oversees the documentation process for all contracts
  • Maintains anup-to-dateknowledge of state construction and procurement laws and related regulations.
  • Directs MCCA’s defense against suits or claims.
  • Prepares the prosecution of the MCCA's claims against others.
  • Supervises and coordinatesthe workof outside counsel and consults with them on sensitive legal issues.
  • Oversees the development and management of budgets. Supervises thefinancial managementof the office of the general counsel.
  • Drafts, reviews andapprovespolicies and procedures, bylaws,resolutionsand other documents related to governance and regulatory compliance of the MCCA.
  • Anticipates andidentifieslegal issues of concern to senior MCCA officials and develops legal strategies and solutions, often in situations of great financial,politicaland or/public significance, and with limited time for assessing alternatives.
  • Supervises the drafting of contracts and related documents for participation in partnerships, procurement ofgoodsand services, and affiliations with other organizations.
  • Acts as Assistant Clerk to the Board of Directors, records,distributesmeeting minutesand materials.
  • Assistswith legal issues related to construction projects.
  • Produces Bid and Specification requirements withassistanceof Contract Administrator
  • Oversees procurement,purchasingand contract administration processes.
  • Assistin the development of internal policies andprocedures,interface with executive management.
  • Other duties as assigned by the Executive Director and/or Board of Directors

SUPERVISION RECEIVED: Supervision as required is provided by the Executive Director and Board of Directors

SUPERVISORY RESPONSIBILITIES: Directly supervises employees in the Legal Department. Carries out supervisory responsibilities in accordance with the organization's policies and applicable laws. Responsibilities include interviewing, hiring, and training employees when necessary; planning, assigning, and directing work; appraising performance; rewarding and disciplining employees; addressing complaints and resolving problems.

EDUCATION/ EXPERIENCE: Law degree (J. D.) plus Massachusetts Bar Certification with a minimum of ten (10) years related experience and/or training including a thorough understanding of State Construction and Procurement laws. Ability to negotiate effectively and be highly organized. Knowledge of state-of-the-art computer word processing and analytical tools such as Excel. WORK SCHEDULE: The work schedule for this position is typically Monday through Friday, however the hours and days may fluctuate based upon the needs of a particular event or project, which would require the ability to work a flexible schedule including late nights, early mornings, long days, weekends and holidays. Occasional travel to various MCCA facilities may be required.
