The College Sports Commission (CSC) is seeking motivated, high-performing, and team- oriented attorney to serve as Staff Attorney within the CSC Legal Department. This position will report either to the Counsel or Associate Counsel, NIL Go.

The CSC Staff Attorney role will be focused on review and analysis of third-party NIL deals with student-athletes. This work will take the general form of making frontline legal determinations on NIL deals under the supervision of CSC leadership and serving as a legal generalist with responsibilities related to legal analysis and drafting.

The CSC’s work policy requires four days per week in-office at its worksite in Tysons Corner, Virginia.

Responsibilities

Under the supervision of, and in partnership with, members of the CSC legal team, serve as a frontline internal resource for legal determinations associated with the clearinghouse for student-athlete’s name, image, and likeness deals with third parties (NIL GO) – with the following specific expectations:

  • Develop deep knowledge of the House Settlement and rules, including all key legal concepts and requirements
  • Review and analyze individual deals submitted to the NIL Go platform as to their compliance with the House settlement, including determinations as to whether individuals/entities are ‘Associated’ and whether specific deals have a ‘valid business purpose.’
  • Draft and send legal and non-legal communications on behalf of the CSC relating to NIL deals submitted in the NIL Go platform, including to student-athletes and academic institutions
  • Partner with other CSC staff to develop a vetted internal knowledge base of NIL deal- related language, methodology, and answers to be deployed in response to common use cases and questions
  • Maintain index of problematic contractual provisions along with related language and communication protocols
  • Effectively “manage up” by elevating complex and/or novel use cases to other members of CSC Legal/Operations teams as appropriate
  • Coordinate with outside counsel regarding arbitration-related preparation and execution as directed
  • Support the broad organizational priority of in-sourcing substantive legal and enforcement work to decrease ongoing reliance on outside service providers

Serve as in-house legal generalist as needed:

  • Review and issue spot third-party service provider contracts, including for consultants, software developers, and back-office service providers
  • Research legal questions as required/directed
  • Support organization’s legal drafting function, including the drafting of policies (internal and external), prospective rules and guidance
  • Develop an understanding of direct revenue sharing dynamics, cap application, and various types of agreements logged on the platform
  • Support substantive review of cap compliance and related rulemaking as needed

  • Maintain a customer service orientation toward all aspects of NIL deal review
  • Support the CEO and Heads of Operations / Investigations as needed on special projects

Qualifications

  • Candidates must hold a J.D. and be licensed to practice law required
  • 1-3 years of relevant experience required

Salary Range: $140,000 - $175,000

The salary range for this position is $140,000 to $175,000. This range is a good faith estimate of the expected salary range for this position, based on a wide range of factors including qualifications, experience and training, operational and business needs and other considerations permitted by law. Starting salaries for new employees are frequently not at the top of the applicable salary range.
