Associate General Counsel, Regulatory & Commercial
Job Summary:
The Associate General Counsel, Head of Regulatory will own the end-to-end legal and regulatory compliance process for all Amorepacific US and Tata Harper products, from early-stage ideation through post-market. This person will be embedded with R&D, Product Development, and Marketing teams in the U.S. and Korea (as needed) throughout the product lifecycle, ensuring that product substantiation, claims, labeling, packaging, advertising, and communications comply with FDA, FTC, and NAD standards, GMP requirements, and applicable state laws (Truth in Labeling, EPR) while proactively identifying and mitigating exposure to consumer class action litigation over false advertising, mislabeling, and deceptive trade practices. The role also requires building and institutionalizing a scalable review process that keeps pace with Amorepacific US's product pipeline and growth trajectory.
Key Responsibilities
- Regulatory Procedure Development. Design and maintain structured review processes, SOPs, approval gates, turnaround standards, and escalation protocols that integrate into existing product development timelines. Partner with business units in the development, implementation, and continued education of the company's marketing and regulatory compliance policies and procedures.
- Product Lifecycle Compliance. Provide legal advice and guidance on compliance with US regulations related to the manufacturing, development, testing, formulation, packaging, labeling, and sale of cosmetics and OTC drug products. Support product development programs and pipelines from concept through commercialization.
- Claims Review and Substantiation. Review potential product claims to determine validity and regulatory compliance. Review and provide guidance on test protocols, consumer research, claim substantiation, and other support data to ensure claims are adequately supported under FDA, FTC, and NAD standards.
- Marketing and Advertising Review. Review marketing materials, artwork, claims, and company communications across all channels and formats (digital, social media, influencer campaigns, and packaging copy) for compliance with applicable laws and regulations, including FTC and FDA requirements.
- Class Action and Litigation Monitoring. Stay abreast of consumer class action litigation trends in false advertising, mislabeling, and deceptive trade practices in the beauty, personal care, and similarly situated consumer products industries. Translate litigation trends into proactive guidance and risk mitigation for Marketing and R&D teams. Assist in managing and coordinating outside counsel on regulatory and advertising related litigation matters for efficiency and cost-effectiveness.
- Regulatory Intelligence. Monitor and analyze changes in FDA regulations (including MoCRA), FTC enforcement, NAD/NARB proceedings, state attorneys general actions, and emerging state and federal legislation affecting cosmetics and OTC products. Stay current on legal challenges occurring in similarly situated industries and communicate regulatory developments and their business impact to leadership and cross-functional stakeholders across R&D, Marketing, and Regulatory teams in both Korea and the U.S.
- Strategic Counseling. Advise and consult with all levels of the organization, including senior leadership, to identify critical legal issues, assess potential legal options, and provide individuals and teams spanning U.S. and Korea-based teams with an analysis and range of possible legal solutions. Exercise independent judgment on company legal and regulatory matters.
- Cross-Functional Education. Develop and deliver training programs for Marketing, R&D, and Product Development teams on claims substantiation, permissible marketing language, regulatory boundaries, and common litigation pitfalls.
Key Experience and Skills:
- J.D. from a top law school; active bar membership in good standing in at least one U.S. jurisdiction. Science/biology undergraduate degree preferred.
- 6-8+ years of marketing, advertising, regulatory, and/or administrative legal experience at an Am Law 200 firm and/or Fortune 1000 company, or equivalent in-house experience.
- Cosmetic and/or OTC industry experience required.
- Experience building or significantly improving compliance review processes, SOPs, or regulatory workflows.
- Strong understanding of FDA compliance, GMP requirements, and FTC advertising substantiation standards as they relate to cosmetic and OTC drug products. Understanding of similar regulations outside of the U.S. is a plus.
- Deep working knowledge of regulations related to product formulation, packaging, labeling, claim substantiation, and NAD/NARB self-regulatory proceedings.
- Familiarity with current trends in consumer class action litigation related to false advertising, product labeling, and deceptive trade practices in the beauty and CPG sectors.
- Experienced business lawyer with the ability to form strong relationships with business leaders and serve as a counterpart to the Marketing, Product Development, and R&D teams. Ability to execute in a fast paced, cross-functional, multi-regional organization while setting appropriate boundaries.
- Experience working within the U.S. subsidiary of a global or foreign parent company, including coordinating with overseas headquarters, is preferred.
- Ability to communicate effectively, exercise good judgment in decision-making, understand and synthesize complex issues, and support the execution of business strategy. Strives for excellence in execution, thinks strategically, and builds collaborative relationships.
- Excellent written and verbal communication skills, including the ability to translate complex regulatory requirements into clear, actionable guidance for non-legal teams.
- Interest in the Korean or Asian beauty market is a plus.
