Role Overview:
The Administrative Hearings Attorney provides sound and timely legal advice to agency departmental representatives. You will ensure compliance with all state and federal laws and statutes. You will also assist by litigating administrative law hearings with the office of Administrative Law Proceedings.
Salary:
The salary for this position traditionally starts at $85,020.00 but may be commensurate with education and work experience. Use our Compensation Calculator to view the total compensation package.
A Day in the Life:
The essential functions of this role are:
- Support the General Counsel in advising BMV departments on legal issues, applicable laws and policies, and potential resolutions.
- Litigate administrative hearings with the Office of Administrative Law Proceedings.
- Formulate solutions that are workable within the structure of motor vehicle laws.
- Interpret court orders and provide legal advice about managing driver and vehicle records.
- Research recent legal decisions and changes in Federal and State motor vehicle laws.
- Receive and assess customer communications, investigate reported issues, and deliver appropriate resolutions.
- Respond to correspondence concerning legal matters.
- Advise the Driver Ability, Credentials, and Fraud and Security Enforcement departments on legal matters.
- Assist department supervisors with reviewing and editing their departments’ policies.
- Review and edit contracts and Memorandums of Understanding between the BMV and other State Agencies.
- Review and edit BMV notices and state forms.
- Participate in continuing legal education programs.
- Perform additional legal assignments as needed.

This position is exempt from overtime compensation for additional work hours that may be required to complete essential functions or other assigned work. Exempt employees may work more than 75 hours in a pay period without additional compensation and must report a minimum of 75 hours per pay period of work hours and/or paid leave taken to receive their base biweekly salary.
What You'll Need for Success:
Credentials:
- A Doctorate of Jurisprudence with 5+ years of legal experience as a practicing attorney.
- Member in good standing with the Indiana State Bar Association.
Additional qualifications:
- Adept at researching, interpreting, and applying federal and state laws and regulations.
- Strong legal research, writing, and litigation skills.
- Able to apply comprehensive knowledge of relevant statutes, case law, and procedural rules.
- Exceptional communication and public speaking abilities.
- Thorough understanding of all functions and operational processes of the Bureau of Motor Vehicles.
- Able to build effective working relationships.
- Ability to perform essential functions with or without reasonable accommodation.
