Description
Provides legal representation on behalf of the State and for the benefit of consumers. Reports to Section Chief - Data Privacy & ID Theft Unit.
Primary Subject Matter of Cases
- Age verification requirements for adult oriented websites
- Security breaches involving unauthorized acquisition of personal information
- Data privacy framework and statutes
- Identity theft, identity deception, fraud
- Credit reporting
Examples of Duties
- Review and analyze case law, statutes, policies, regulations, and other legal authorities relevant to subject matter.
- Maintain caseload of investigation and litigation cases involving violations of age verification, data privacy, security breach, identity theft, credit reporting, and related consumer protection laws.
- Research and write motions, briefs, pleadings, discovery, and charging documents effectively.
- Handle all phases of litigation. Prepare cases for trial. Appear in court and present evidence and arguments before judges and juries. Review records, conduct depositions, argue motions, issue subpoenas and discovery as appropriate. Negotiate settlements.
- Evaluate complaints and investigative files to determine feasibility and effectiveness of civil, criminal, or referral actions.
- Communicate and build relationships with prosecutors and law enforcement officials in Indiana and other jurisdictions. Assist local prosecutors as requested. Seek deputization in appropriate cases.
- Interact with general public to answer questions, provide educational materials and referral information, and gather data.
- Attend presentations and meetings with law enforcement, other government agencies, and general public regarding subject area.
- Attend conferences, trainings, seminars to learn about legal trends in subject area and to develop relationships and communication protocols with interstate officials.
- Summarize cases, update supervisors, and present recommendations for disposition of cases.
- Supervise work of assigned paralegal, legal assistant, and investigator.
- Perform other tasks and special projects as assigned by Section Chief.
Typical Skills and Qualifications
Preferred Qualifications
- At least two (2) years of prior litigation experience preferred
- Ability to work on age verification matters involving explicit content preferred
- Familiarity with data privacy and data security law preferred
- Familiarity with complex computer processes and new technologies preferred
Minimum Qualifications
- License to practice law in Indiana
- Strong written and oral communication skills
- Ability to balance and manage high volume of cases and investigations and to handle multiple assignments of varied type and difficulty on ongoing basis
- Knowledge of state and federal rules of procedure
- Legal research and writing skills
- Ability to work with complainants, witnesses, and staff; sensitivity and awareness of public relations and political implications of high-profile cases
- Strong sense of ethics, awareness of potential conflicts of interest that arise in public sector, adherence to Rules of Professional Conduct and state ethics rules

Salary Range Based on Years of Experience:
Deputy Attorney General I (0-2 years of practice): $76,597 - $82,000
Deputy Attorney General II (2-5 years of practice): $82,000 - $87,000
Deputy Attorney General III (5-8 years of practice): $87,000 - $94,000
Deputy Attorney General IV (8+ years of practice): $94,000 - $104,000+
